These Terms & Conditions (“Terms”) form a binding agreement between you and Lykos Training Center Inc. (“Lykos,” “we,” “us,” or “our”). By accessing or using our website, creating an account, registering for any course or event, making payment, attending training, observing training, or otherwise using any Lykos services, you agree to be bound by these Terms. If you do not agree, you must not use the website, register for training, or attend any Lykos activity.

 

1. Scope

These Terms apply to:

• Use of the Lykos website and online systems;

• Registration for any class, course, or event;

• Attendance at the Lykos Training Center facility in Rochester, Massachusetts;

• Participation in any off-site training, event, or instruction conducted by Lykos; and

• Observation of any class or training activity where permitted.

 

2. Eligibility, Age Requirements, and Minors

Participants and observers must be at least fifteen (15) years old to enter the property or attend any training or observation activity.

Anyone under eighteen (18) years old is considered a minor and may attend only with the prior consent of a parent or legal guardian. The parent or legal guardian must:

• Complete all registration requirements,

• Sign all required agreements, including the Firearms Training Agreement – Waiver of Liability & Assumption of Risk (the “Firearms Training Agreement”), on behalf of the minor; and

• Accept full responsibility for the minor’s conduct, supervision, and compliance with all Lykos rules and policies.

 

By registering, you represent that you are either:

• At least eighteen (18) years old and legally able to enter this agreement; or

• The parent or legal guardian authorized to enter this agreement on behalf of a minor.

3. Agreement to Policies and Required Documents

• Participation in any Lykos activity requires compliance with all applicable Lykos policies, including but not limited to:

  • Safety & Range Policy

  • Booking & Cancellation Policy

  • Privacy Policy

  • Firearms Training Agreement

• Where required by Lykos, registration or attendance may be conditioned upon completion of waivers, releases, acknowledgments, and related documents.

• ​If there is any conflict between these Terms and the Waiver of Liability or Firearms Training Agreement regarding assumption of risk, releases, liability limitations, or safety matters, the Waiver of Liability and/or Firearms Training Agreement shall control to the maximum extent permitted by law.

 

4. Participant Responsibilities and Equipment

• Participants are solely responsible for bringing any firearms, ammunition, holsters, eye and ear protection, and other equipment required for their course unless expressly stated otherwise by Lykos.

• All firearms and equipment must be lawful, safe, and in proper working condition. Lykos staff may inspect any firearm or equipment at any time and may prohibit use of any item deemed unsafe, defective, prohibited, or unsuitable for the course.

• If a participant cannot continue training because their equipment is unsafe, prohibited, fails, or is otherwise unsuitable, no refund, credit, or rescheduling shall be required except as expressly stated in the Booking & Cancellation Policy.

• Participants are solely responsible for knowing and complying with all federal, state, and local laws applicable to firearms, transportation, storage, licensing, and possession.

 

5. Safety, Refusal of Service, and Removal

• Lykos Training Center may, in its sole discretion, refuse service, deny entry, cancel participation, or remove any participant or observer from any course, event, or premises if that person:

  • Violates any Lykos policy or instructor direction;

  • Appears impaired by alcohol, drugs, or any substance;

  • Acts in an unsafe, negligent, disruptive, abusive, or threatening manner;

  • Violates applicable law; or

  • Creates a safety concern for any person or property.

• If participation is denied or terminated for cause, no refund, credit, or rescheduling shall be required except where prohibited by law.

 

6. Assumption of Risk and Access to Premises

• Firearms training and related activities involve inherent risks, including serious bodily injury, death, and property damage. Participation is voluntary, and additional details regarding risks are addressed in the Firearms Training Agreement.

• These risks, including risks associated with travel to and from the facility and use of access roads, are described in more detail in the Firearms Training Agreement, which you must sign before participating. In the event of any conflict between these Terms and that Agreement regarding risks and assumption of risk, the Agreement will control.

 

7. No Guarantees / Licensing Disclaimer

• Lykos Training Center does not guarantee any specific training result, skill level, qualification, or outcome.

• Completion of training does not guarantee future safety, success in any real-world encounter, or proficiency under stress.

• Lykos may issue certificates of completion where appropriate. However, no certificate or course guarantees issuance, renewal, approval, or acceptance of any firearms license, permit, credential, or governmental authorization. Participants are solely responsible for confirming whether any course satisfies the requirements of any licensing authority or agency.

• Lykos is not responsible for delays, denials, suspensions, revocations, or decisions made by any governmental body, licensing authority, law enforcement agency, or employer.

 

8. Booking, Payment, Cancellations, and Scheduling

• All payments, deposits, cancellations, refunds, rescheduling, and no-show matters are governed by the Booking & Cancellation Policy in effect at the time of registration, unless otherwise required by law.

• Lykos reserves the right to change instructors, class sizes, schedules, course content, or training dates, and to cancel or reschedule any offering when necessary for safety, staffing, weather, operational, or other legitimate business reasons.

 

9. Intellectual Property and Recording

• All course materials, videos, documents, lesson plans, trademarks, logos, and resources provided by Lykos remain the exclusive property of Lykos Training Center Inc. unless otherwise stated.​

• Participants receive a limited, non-exclusive, non-transferable license to use provided materials solely for their own personal educational use. You may not:

  • Copy, reproduce, distribute, sell, publish, or modify materials;

  • Use materials to provide competing training services;

  • Remove copyright or trademark notices; or

  • Record live instruction for commercial use without written permission.

• Participants may take personal photos or videos only if doing so does not interfere with safety, instruction, privacy, or operations. Lykos may restrict or prohibit photography or recording at any time.

• Lykos may photograph or record training sessions for safety, training, promotional, or business purposes, subject to applicable law and to any opt‑outs or limitations you have exercised under our media release and Privacy Policy.

 

10. Limitation of Liability

• To the fullest extent permitted by law, Lykos Training Center Inc., its owners, officers, employees, instructors, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the website, participation in training, attendance at the premises, or use of services.

• Nothing in these Terms limits liability to the extent such liability cannot be lawfully limited, including liability arising from gross negligence, willful misconduct, or any non-waivable legal duty.

 

11. Indemnification

• You agree to defend, indemnify, and hold harmless Lykos Training Center Inc., its owners, officers, employees, instructors, contractors, and agents from third-party claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from:

  • Your violation of law;

  • Your violation of these Terms or any Lykos policy;

  • Your negligent or wrongful acts; or

  • Your misuse of firearms, equipment, or property.

• This section does not apply to the extent a claim results from Lykos’s gross negligence or willful misconduct.

 

12. Policy Updates

• Lykos may revise these Terms and related policies from time to time by posting updated versions on its website or otherwise making them available.

• For a specific training registration, the policies in effect at the time of registration will generally govern that enrollment, unless changes are required for safety, legal compliance, or operational necessity.

• Continued use of the website or registration for future services after updates are posted constitutes acceptance of those updated Terms for future transactions.

 

13. Governing Law, Venue, and Disputes

• These Terms shall be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.

• Any dispute arising out of or relating to these Terms, the referenced policies, or participation in any Lykos activity shall be brought exclusively in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction of those courts.

 

14. Severability and Entire Agreement

• If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

• These Terms, together with the Safety & Range Policy, Booking & Cancellation Policy, Privacy Policy, and Firearms Training Agreement, constitute the entire agreement between you and Lykos Training Center regarding the subject matter addressed herein and supersede prior discussions or understandings.
